Understand the principles of mental capacity in adult care

Case study

Bethan is 21 and autistic. She also has Severe Learning Difficulties and Global Developmental Delay. Bethan has been in a residential educational placement that was funded by the Local Authority; however she has not been enjoying it and her mother feels that Bethan would prefer to be living at home.

  1. Does Bethan’s mother have the legal ability to decide that Bethan should live at home?
  2. How would you work to determine whether Bethan had capacity to make decisions?

It is rare that there is just one way to respond to a scenario or situation, so do not consider that the responses you have to the above scenario will be judged as right or wrong. Share your scenario with a work colleague or friend and ask them to tell you whether they think you have responded appropriately. Ask them to challenge your response if necessary. You do not need to submit this task for assessment unless asked to do so by your assessor.
